1. Account Registration and Security

To use our AI tools, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your password and account credentials.
• Accept full responsibility for all activities that occur under your account.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and purchase subscriptions.

2. Subscriptions, Credits, and Billing

HootGPT offers both recurring monthly/yearly subscriptions and prepaid “a la carte” credit packs.

• Billing: By providing a payment method, you authorize us (through our secure payment processors) to charge your designated payment method for the total amount of your purchase or recurring subscription.
• Credits: Certain features (like image, video, and audio generation) consume “Media Credits” or “Text Credits.” Credits purchased via top-up packs do not expire as long as your account remains active.
• Cancellations: You may cancel your recurring subscription at any time through your account dashboard. Cancellation will stop future billing, but you will retain access to your plan's features until the end of your current billing cycle.

3. Refund Policy

We want you to be completely satisfied with HootGPT. We offer a 7-day refund policy on all initial purchases. If you are not satisfied with the Service, you may request a full refund within 7 days of your first subscription payment or credit top-up purchase. Note: Refunds are not guaranteed for accounts that have violated our Acceptable Use Policy.

4. Acceptable Use Policy

You agree not to use HootGPT's AI models to generate, upload, or share content that is:

• Illegal, harmful, or promotes violence or discrimination.
• Sexually explicit or pornographic.
• Intended to harass, bully, or defame others.
• Used for generating deepfakes for malicious purposes, spreading misinformation, or committing fraud.
• Infringing on the intellectual property rights, copyright, or privacy of any third party.

We reserve the right to suspend or terminate your account immediately, without refund, if we determine you have violated these rules.

5. Intellectual Property and Content Ownership

• Your Generated Content: Subject to the terms of our third-party AI providers, you retain ownership of the text, images, audio, and video you generate using HootGPT. You are free to use your generated assets for commercial and non-commercial purposes.
• Our Platform: The HootGPT platform, including its original code, design, branding, and proprietary algorithms, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform's code or design.

6. Third-Party AI Providers

HootGPT leverages APIs from enterprise AI vendors (such as OpenAI, Anthropic, Gemini, etc.). While we strive for maximum uptime, the availability, speed, and output quality of our generation tools are directly dependent on these third-party services. We are not liable for temporary outages or API limitations caused by these vendors.

7. Limitation of Liability

To the maximum extent permitted by law, HootGPT and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the UAE.

9. GDPR & Data Protection Rights

If you are located in the European Economic Area (EEA) or the United Kingdom, you are entitled to certain rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict, and port your personal data. You also have the right to object to certain processing and to withdraw consent at any time.

We process your personal data on the lawful bases of contractual necessity, legitimate interest, consent, and legal obligation as described in our Privacy Policy.
